Norman's identification of a ventral system embodying a constructivist theory of perception is rejected in favor of an ecological theory of perception and perceptual learning. We summarize research showing that a key motivation for the ventral-constructivist connection, percept-percept coupling, confuses perceptual and post-perceptual processes.

Maintaining effectiveness of medical-legal partnerships and consistently identifying opportunities for innovation and adaptation takes intentionality and effort. In this paper, we discuss ways in which our use of data and quality improvement methods have facilitated advocacy at both patient (client) and population levels as we collectively pursue better, more equitable outcomes.

Applied general equilibrium models have received considerable attention and scrutiny in the public debate over the North American Free Trade Agreement. This collection brings together the leading AGE models that have been constructed to analyse NAFTA. A variety of approaches to modelling trade liberalization are taken in these studies, including multi-country and multi-sectoral models, models that focus on institutional features of particular sectors affecting multinational firms and rules of origin, and models with some inter-temporal structure. Further, by constructing stylized models, (...) theoretical linkages have been identified that drive numerical results in the larger AGE models. The volume also assesses what can be learned about the likely economic effects of NAFTA from the collection of studies taken as a whole. Areas in need of further study have been highlighted. The purpose of this study was to adapt the Austrian-German version of the Multidimensional Inventory for Religious/Spiritual Well-Being into the Italian language and culture, and to investigate possible associations between the RSWB dimensions, “Big Five” personality factors and mental illness within an Italian student sample. Hence, the first Italian translation of the MI-RSWB scale was applied on a sample of 412 undergraduate students in three different cities and regions of Italy: Padova, Rome, and Palermo. Like the original Austrian-German scale, we (...) were able to find convincing psychometric properties for the new Italian version of the scale. By mirroring previous research, the RSWB-dimensions turned out to be substantially associated with personality dimensions, as well as negatively related with a global measure of mental illness. Our initial results confirm that these RSWB-dimensions are important facets of personality and mental health. (shrink)

Foucauldian discourse analysis (FDA) is a methodology that is well suited to inquiring into nursing knowledge and its organization. It is a critical analytic approach derived from Foucault's histories of science, madness, medicine, incarceration and sexuality, all of which serve to exteriorize or make visible the ‘positive unconscious of knowledge’ penetrating bodies and minds. Foucauldian discourse analysis (FDA) holds the potential to reveal who we are today as nurses and as a profession of nursing by facilitating our ability to identify (...) and trace the effects of the discourses that determine the conditions of possibility for nursing practice that are continuously shaping and (re)shaping the knowledge of nursing and the profession of nursing as we know it. In making visible the chain of knowledge that orders the spaces nurses occupy, no less than their subjectivities, FDA is a powerful methodology for inquiring into nursing knowledge based on its provocation of deep critical reflection on the normalizing power of discourse. We survey the development of “California Phenomenology”, both as a philosophical movement originating with Dagfinn Føllesdal’s formulation of a Fregean, analytic reading of Husserl in the late 1950s and 1960s, and as an evolving network of philosophers working throughout California, who have met under the auspices of several groups in a more or less continuous way since that time. We trace the history of these groups in detail, provide an overview of debates that occurred between “West Coast” approaches to Husserlian (...) phenomenology and other approaches, and survey the broad panorama of more recent work. Der forskes stadig i Aristoteles verden over, men moderne fortolkere drager kun sjældent nytte af den rige ældre tradition. Denne bog beskriver og sammenligner fortolkningsmetoder og publikationsstrategier hos skolastikerne og nutidens aristotelikere. Der argumenteres for, at dele af den gamle metodik (...) med fordel kunne genoptages, og det vises, at der i konkrete tilfælde kan findes værdifulde fortolkningsforslag, som ikke ses i den nyere litteratur. Within the debate concerning reason and rationality, instrumental incoherence was for a long time conceived of as the paradigm of irrationality. However, with the emergence of the so-called ‘bootstrapping objection’ and the debate concerning the ‘scope’ of rational requirements, the innocuous status of the normative significance of (instrumental) coherence became subject to. This led to a paradigmatic shift in how to understand the relationship between rational requirements and normativity. While there now exists considerable doubt that rational requirements are normative, it (...) is commonly agreed that one’s normative point of view is a key feature of one’s rationality. Here the question is not only if one can hold a particular normative judgement and still be rational; what is significant too is whether your normative outlook coheres appropriately with your motivation. In fact, it is now commonly agreed that rationality requires us to intend to make the world fit with our first-personal ought beliefs. Enkrasia (i.e. coherence between your normative views and your motivation) is thus seen as a rational ideal and as a source of rational requirements. Nevertheless, many elementary questions regarding the application, content, and significance of an enkrasia-requirement remain unanswered, or subject to debate. This special issue on ‘The Nature of the Enkratic Requirement of Rationality’ aims to answer some of these fundamental questions. (shrink)

Does a coherentist version of rationality issue requirements on states? Or does it issue requirements on processes? This paper evalu- ates the possibility of process-requirements. It argues that there are two possible definitions of state- and process-requirements: a satisfaction- based definition and a content-based definition. I demonstrate that the satisfaction-based definition is inappropriate. It does not allow us to uphold a clear-cut distinction between state- and process-requirements. We should therefore use a content-based definition of state- and pro- cess-requirements. However, a (...) content-based definition entails that ra- tionality does not issue process-requirements. Content-based process- requirements violate the principle that ‘rationality requires’ implies ‘can satisfy’. Es wird versucht nachzuweisen wiesehr Husserl neben der immer erneuten Übung der Phänomenologie als ein Instrument genauester philosophischer Analyse immer mit metaphysischen Fragen „alten Stils” beschäftigt gewesen ist : Ursprung der Welt, Existenz Gottes, Möglichkeit und Sinn der Geschichte, Unsterblichkeit. Solche und ähnliche Probleme hat er angeschnitten und neu zu beantworten versucht auf dem von ihm nie verlassenen Boden der transzendentalsubjektiven Phänomenologie. Die Frage ist eben wie eine solche Phänomenologie, die vom Bewusstsein als dem Absoluten, das „nulla ‘re’ indiget ad (...) existendum” ausgeht und daran immer festgehalten hat mit der metaphysischen Problematik ins Reine kommt, namentlich wenn das mit der Transzendenz Gottes gemeinte Absolute dem Bewusstseinsabsoluten gegenüber als „ total verschieden” und „übertranszendentalsubjektiv” bezeichnet wird. Stösst das transzendentale Bewusstsein irgendwo auf Absolutes, das es unter Verzicht auf seinen konstitutiven Leistungscharakter ohne weiteres hinzunehmen hat ? Von Fink stammt die Bemerkung dass man Husserl als dem „Philosophen des Kleingeldes” seine unspekulative Gesinnung nicht als Schwachheit anrechnen darf, weil in der sorgfältigen Analyse eben seine Stärke liege. Ich möchte demgegenüber betonen dass eine „manque d'esprit métaphysique” sich bei Husserl eben nicht nachweisen lässt, wie auch aus seinen geschichtsphilosophischen Bemühungen eindeutig hervorgeht. In dieser letzten Beziehung liesse sich fragen inwiefern eine Philosophie, die den Ursprung der Geschichte in die transzendentale Subjektivität verlegt auf die „wirkliche” Geschichte als das „grosse Faktum des absoluten Seins” sich zu berufen ein Recht hat. Jedenfalls dürfte klar sein dass es neben Husserl, dem geduldigen, sorgfältigen, auf das Detail hinsehenden phänomenologischen Analytiker einen durch metaphysische Fragen in andauernder Unruhe versetzten Husserl gegeben hat. In the opening chapter of the Iudicium de Dinarcho Dionysius quotes a passage from the Περì μωνμων of Demetrius Magnes, mat the end of which come the words δ λξις ςτ το Δεινρχου κυρως θικ πθος κινοσα σχεδòν τ πικρí μóνον καì τ τóν το Δημοσθθενικο χαρακτρος λειπομνη το δ πιθανο καì κυρíιυ μηδν νδονσα. [I have deliberately omitted all punctuation marks, because the punctuation of this sentence is still doubtful, though I hope to suggest a possible interpretation of its (...) meaning at the end of this article.] Now there is nothing in this sentence or in the words preceding it to indicate beyond all possibility of doubt the precise meaning ofκυρíως θικ. And in such circumstances, to allow free play to personal prejudices regarding the significance of thephrase is more than dangerous. The whole problem of θικ λξις has been treated too cursorily. If one mentions the phrase to a non-professional student of Greek, who, however, has some acquaintance with the Attic orators, he immediately replies: ‘I suppose you mean the sort of thing you meet in Lysias.’ And he is to beexcused, because, after all, that is the predominant meaning of the term. But it has other senses, and therefore one must fight shy of vague statements like that of Finke, who, after quoting the above lines, comment: ‘Demetrius Magnus attribuit ei τν κυρíαν λξιν qua non sit Demosthene inferior’; or of Burgess, who enumerates qualities, ideas, and topics ‘of special value to the epideictic and court orators, ’ among which appears θοποια which he merely translates ‘impersonation or delineation of character, ’ without offering any further comment. Sandys talks of ‘the ethical warmth of colouring, by which the dullest details are lit up with a fresh life and interest.’ Gromska is even more vague (and seems almost to confuse θς and χαρακτρ: ‘Grammatici antiqui, qui de Hyperide tractabant, de eloquentiae eius genere disputabant, orationum Hyperidearum compositionem et θς respicientes, i.e. quantum in arte rhetorica et oratoria valeret, examinantes.’ In the hope, therefore, of being able to represent the difficulty inherent in these lines, and of attempting to remove it, or at any rate to shed a broader beam of light upon it than has been shed hitherto, I propose to review very briefly the fluctuations of meaning in the life of this phrase and its equivalents, as we find them used in the critical writings of the Greek philosophers and rhetoricians. Congress's national-security legislation will often require clear and specific congressional authorization before the executive can undertake certain actions. The War Powers Resolution, for example, prohibits any law from authorizing military hostilities unless it "specifically authorizes" them. And the Foreign Intelligence Surveillance Act of 1978 required laws to amend FISA or repeal its "exclusive means" provision before they could authorize warrantless electronic surveillance. But efforts to legislate clear-statement regimes in national-security law have failed to induce compliance. The Clinton Administration inferred (...) congressional "authorization" for the 1999 Kosovo War from an appropriations statute that failed to specifically authorize the conflict. And the Bush Administration inferred congressional "authorization" for the NSA surveillance program from ambiguous language in the post-September 11th Authorization to Use Military Force. In both situations, executive-branch lawyers employed expansive theories of implied repeal and constitutional avoidance to evade the codified clear-statement requirements, and Congress and the courts acquiesced to the President's actions. Recent proposals to strengthen the clear-statement requirements in Congress's national-security framework legislation are unlikely to be effective without institutional mechanisms, such as points of order, that can deter future legislators from enacting vague or ambiguous legislation from which the executive might claim implicit congressional "authorization," and that can induce Congress to confront Presidents that act without specific congressional authorization. Simply enacting more narrow or explicit clear-statement requirements, or adding funding restrictions to Congress's framework legislation, fails to counter the aggressive interpretive doctrines that executives of both political parties have used to concoct congressional "authorization" from vague or ambiguous statutory language. A growing amount of media is paid for by its consumers through their very consumption of it. Typically, this new media is web-based and paid for by advertising. It includes the services offered by Facebook, Instagram, Snapchat, and YouTube. We offer an ethical assessment of the attention economy, the market where attention is exchanged for new media. We argue that the assessment has ethical implications for how the attention economy should be regulated. To conduct the assessment, we employ two heuristics (...) for evaluating markets. One is the “harm” criterion, which relates to whether the market tends to engender extremely harmful outcomes for individuals or society as a whole. The other is the “agency” criterion, which relates not to the outcomes of the market, but rather, to whether it somehow reflects or has its source in weakened agency. We argue that the attention economy animates concerns with respect to both criteria and that new media should be subject to the same sort of regulation as other harmful, addictive products. (shrink)

The period from Plato's birth to Aristotle's death (427-322 BC) is one of the most influential and formative in the history of Western philosophy. The developments of logic, metaphysics, epistemology, ethics and science in this period have been investigated, controversies have arisen and many new theories have been produced. But this is the first book to give detailed scholarly attention to the development of dialectic during this decisive period. It includes chapters on topics such as: dialectic as interpersonal debate between (...) a questioner and a respondent; dialectic and the dialogue form; dialectical methodology; the dialectical context of certain forms of arguments; the role of the respondent in guaranteeing good argument; dialectic and presentation of knowledge; the interrelations between written dialogues and spoken dialectic; and definition, induction and refutation from Plato to Aristotle. A number of findings in the field of machine learning have given rise to questions about what it means for automated scoring- or decisionmaking systems to be fair. One center of gravity in this discussion is whether such systems ought to satisfy classification parity (which requires parity in accuracy across groups, defined by protected attributes) or calibration (which requires similar predictions to have similar meanings across groups, defined by protected attributes). Central to this discussion are impossibility results, owed to Kleinberg (...) et al. (2016), Chouldechova (2017), and Corbett-Davies et al. (2017), which show that classification parity and calibration are often incompatible. This paper aims to argue that classification parity, calibration, and a newer, interesting measure called counterfactual fairness are unsatisfactory measures of fairness, offer a general diagnosis of the failure of these measures, and sketch an alternative approach to understanding fairness in machine learning. Prediction-based decisions, which are often made by utilizing the tools of machine learning, influence nearly all facets of modern life. Ethical concerns about this widespread practice have given rise to the field of fair machine learning and a number of fairness measures, mathematically precise definitions of fairness that purport to determine whether a given prediction-based decision system is fair. Following Reuben Binns (2017), we take ‘fairness’ in this context to be a placeholder for a variety of normative egalitarian considerations. We (...) explore a few fairness measures to suss out their egalitarian roots and evaluate them, both as formalizations of egalitarian ideas and as assertions of what fairness demands of predictive systems. We pay special attention to a recent and popular fairness measure, counterfactual fairness, which holds that a prediction about an individual is fair if it is the same in the actual world and any counterfactual world where the individual belongs to a different demographic group (cf. Kusner et al. (2018)). (shrink)

Data-driven, decision-making technologies used in the justice system to inform decisions about bail, parole, and prison sentencing are biased against historically marginalized groups (Angwin, Larson, Mattu, & Kirchner 2016). But these technologies’ judgments—which reproduce patterns of wrongful discrimination embedded in the historical datasets that they are trained on—are well-evidenced. This presents a puzzle: how can we account for the wrong these judgments engender without also indicting morally permissible statistical inferences about persons? I motivate this puzzle and attempt an answer.

This paper examines the practice of using predictive systems to lengthen the prison sentences of convicted persons when the systems forecast a higher likelihood of re-offense or re-arrest. There has been much critical discussion of technologies used for sentencing, including questions of bias and opacity. However, there hasn’t been a discussion of whether this use of predictive systems makes sense in the first place. We argue that it does not by showing that there is no plausible theory of punishment that (...) supports it. (shrink)

This chapter spells out in detail how Kant’s thinking about logic during the critical period shapes the account of philosophy that he gives in the Critiques. Tolley explores Kant’s motivations behind his formation of the idea of a new “transcendental” logic, drawing out in particular how he means to differentiate it from the traditional “merely formal” approaches to logic, insofar as transcendental logic investigates not just the basic forms of the activity of thinking but also its basic contents. Kant’s understanding (...) of both of these logics directly factor into the first Critique’s more general project of the critique of reason in particular, as not just a capacity for a certain kind of thinking (inferring), but as a possible source of a priori cognition. New media (highly interactive digital technology for creating, sharing, and consuming information) affords users a great deal of control over their informational diets. As a result, many users of new media unwittingly encapsulate themselves in epistemic bubbles (epistemic structures, such as highly personalized news feeds, that leave relevant sources of information out (Nguyen forthcoming)). Epistemically paternalistic alterations to new media technologies could be made to pop at least some epistemic bubbles. We examine one such alteration that Facebook has made in (...) an effort to fight fake news and conclude that it is morally permissible. We further argue that many epistemically paternalistic policies can (and should) be a perennial part of the internet information environment. (shrink)

Impermissivists hold that an agent with a given body of evidence has at most one rationally permitted attitude that she should adopt towards any particular proposition. Permissivists deny this, often motivating permissivism by describing scenarios that pump our intuitions that the agent could reasonably take one of several attitudes toward some proposition. We criticize the following impermissivist response: while it seems like any of that range of attitudes is permissible, what is actually required is the single broad attitude that encompasses (...) all of these single attitudes. While this might seem like an easy way to win over permissivists, we argue that this impermissivist response leads to an indefensible epistemology; permissive intuitions are not so easily co-opted. Eugen Fink is considered one of the clearest interpreters of phenomenology and was the preferred conversational partner of Edmund Husserl and Martin Heidegger. In Play as Symbol of the World, Fink offers an original phenomenology of play as he attempts to understand the world through the experience of play. He affirms the philosophical significance of play, why it is more than idle amusement, and reflects on the movement from "child's play" to "cosmic play." Well-known for its non-technical, literary (...) style, this skillful translation by Ian Alexander Moore and Christopher Turner invites engagement with Fink's philosophy of play and related writings on sports, festivals, and ancient cult practices. We offer an ethical assessment of the market for data used to generate what are sometimes called “consumer scores” (i.e., numerical expressions that are used to describe or predict people’s dispositions and behavior), and we argue that the assessment has ethical implications on how the market for consumer scoring data should be regulated. To conduct the assessment, we employ two heuristics for evaluating markets. One is the “harm” criterion, which relates to whether the market produces serious harms, either for participants (...) in the market, for third parties, or for society as a whole. The other is the “agency” criterion, which relates to whether participants understand the nature and significance of the exchanges they are making, if they can be guaranteed fair representation, or if there is differential need for the market’s good. We argue that consumer scoring data should be subject to the same sort of regulation as the older FICO credit scores. Although the movement in the 1990s that was aimed at regulating the FICO scores was not aimed at restraining a market per se, we argue that the reforms were underwritten by concerns about the same sorts of problems as those outlined by our heuristics. Therefore, consumer data should be subject to the same sort of regulation. (shrink)

Die schnell anwachsende Hinneigung zur Existentialanalytik, zur Lebensphilosophie und zur Ontologie am Anfang der 30er Jahre zwang Edmund Husserl dazu, die ursprungliche, als transzendentale ausgereifte Phanomenologie in methodischer und systematischer Hinsicht von diesen neuen Tendenzen scharf abzugrenzen. In den Jahren 1930 bis 1932 entwarf Eugen Fink im Auftrag seines Lehrers eine Reihe von Texten zur Phanomenologie, die grundlegende Bedeutung haben sollten fur ein Systematisches Werk der Phanomenologie bzw. als neue Meditations cartesiennes fur das deutsche Publikum gedacht waren. Diese Entwurfe (...) Eugen Finks kulminierten in der VI. Cartesianischen Meditation (1932), die u. a. von Gaston Berger, Maurice Merleau-Ponty und Tran Duc Thao in Frankreich rezipiert wurde, bevor Fink sie im Jahre 1946 als Habilitationsschrift an der Freiburger Universitat einreichte. Der vorliegende Band, der in chronologischer Reihenfolge die im Auftrag Husserls verfassten Entwurfe Finks aus den Jahren 1930-32 veroffentlicht, schliesst unmittelbar an die Bande 1 (Studien zur Phanomenologie) und 3 (Phanomenologische Werkstatt) der Eugen Fink Gesamtausgabe an. In diesen Texten gewinnt Finks origineller Beitrag zur Phanomenologie Husserls in der Freiburger Zeit eine Konturenscharfe, die von Sartre und Merleau- Ponty fruh erkannt wurde. (shrink)
